Re: Motion to transfer venue for litigation arising from request to the FBI for records concerning criminal background check Disposition: Transferring action on court’s own motion to the Central District of California
- Litigation Considerations, Jurisdiction: The court transfers the remaining FOIA claim against the federal defendants on the court’s own motion to the United States District Court for the Central District of California, Western Division, after finding that the "action could have been brought in the Central District of California" and "the interests of fairness and convenience strongly favor transfer. " The court notes that "a substantial part of the events or omissions giving rise to the claims in this suit took place within that district, which is where Plaintiff was employed by and terminated by [defendant]." The court specifically notes that "[p]laintiff resides in that district" and that the district court of the United States in the district in which the plaintiff resides is a proper venue for FOIA claims.
